Father arrests Milton family court judge!

Milton family court shocked as father attempts to arrest judge for CRIMES AGAINST HUMANITY!

Father abused by family court system stands up against the bias and injustice being perpetrated against his family.

In a daring move that should bring some much needed attention to the many gross injustices being perpetrated against fathers and children by Canada’s family court system, a Burlington, Ontario area father did something that few would have the courage and resolve to do.

On June 13, 2002, after having justice delayed yet another time for himself and his children, Mr. Peter Cornakovic of Burlington, Ontario, did something very brave as a citizen – he placed the family court judge under a citizen’s arrest.

The judge, Mr. Justice Terrance O'Connor of the Milton Family Court was visibly shocked by the event.

According to eye witnesses in the court, as Mr. Cornakovic calmly approached the judge’s bench, he asked that police be summoned and shortly after that announced to the judge in the presence of witnesses in the court, "I'm placing you under citizen's arrest for crimes against humanity.”

After announcing the judge’s arrest, Cornakovic placed his hand on the judge’s shoulder so that the judge would remain in the court until arrival of police. Mr. Cornakovic knew that court security officers were only moments away and only wished that the judge remain in court until police arrived.

Rather than dealing calmly and rationally with the situation by just simply speaking face to face with the father and waiting for the police to arrive so that matters could be dealt with then, Justice O’Connor shrugged off Mr. Cornakovic and attempted to walk away from him.

Some reasonable people would argue that for a person to deliberately turn their back on another person under similar circumstances would not be the most appropriate way to peacefully resolve such a situation and that dialogue would have been a better place to begin.

In fact, some would interpret walking away as a kind of “slap in the face” gesture intended to incite confrontation and an adverse reaction from the other party.

For a common citizen from the community to actually have the courage and resolve to approach the sanctity of the judge’s bench and to dare lay a hand on a judge’s body may have been beyond this judge’s level of comprehension.

Not even for one moment did the judge seem willing to consider the possibility that a common citizen had the right to challenge the court.

Could it be that Justice O’Connor was offended at being approached in his court and felt it below his dignity to speak to this ordinary citizen without having to stand behind the stifling rules of the court?

Many Judges have become so arrogant as to believe that they are above the laws that govern ordinary Canadians. In Canada today, the judges, not the elected representatives seem to be making the law.

In this case, Mr. Cornakovic believed that the court was acting outside of its jurisdiction by failing to follow the principles of fundamental justice by failing to ensure equality and encouraging gender discrimination against him as a father.

FATHER PHYSICALLY ATTACKED AND ASSAULTED IN THE COURT

Although Mr. Cornakovic’s clearly made his intentions known prior to approaching the judge and at no time did he do or say anything that could be interpreted by a rational person as physically threatening or violent, he was attacked from behind by his former brother-in-law who put him in a headlock and tried to wrestle him to the ground.

One court worker who did not wished not to be named, indicated that some court staff felt that excessive force had been used against Cornakovic and that if anyone was physically assaulted in court that day, it was Cornakovic, not the judge.

When police did arrive, as can be expected, they automatically sided with the judge and arrested Cornakovic for assaulting the judge. Police paid no attention to Ms. Cornakovic’s complaints about the injustices being perpetrated against his family by the court nor was any attention paid to the physical assault against Cornakovic in the court.

Cornakovic was thrown in jail and charged with assaulting the judge, a charge that ultimately will further punish the loving father for daring to touch a judge and daring to challenge the authority of the court.

Father and his children devastated by 7-year family court battle Cornakovic, an accountant, has endured a exhausting seven-year legal battle since separating from his wife in 1995. Although the couple’s children live with Mr. Cornakovic, the court still expected him to pay over $1000 in support payments to his former wife who has refused to pay child support she owed for the kids.Mr. Cornakovic, a single parent, was frustrated with the fact that while he struggled to support himself and the children, the court expected him to pay money to his wife who appears to be financially well off and living in a luxurious 3,000 sq. ft. home with her current boyfriend.

Mr. Cornakovic was in court attempting to get relief for his children in a fair and expedient manner but rather than help this single father and his children, Justice O’Conner adjourned justice with yet another delay.

Although the adjournment did not appear to be a monumental event on its own, taken in context with the other events in Mr. Cornakovic’s case over the past seven years, it was just one more example of the legal hurtles and abuse of process that are thrown in front of fathers to wear them down one step at a time by the court process over a painfully slow and extended period of time.

After seven years of frustration as a result of the court process and the threat of losing the children’s home, Mr. Cornakovic felt he and his family had suffered enough abuse of process at the hands of the court system. Just as David once stood up against Goliath, Mr. Cornakovic decided to stand up against the tyranny of court by peacefully arresting the judge.

CANADIANS FED UP WITH FAMILY COURT SYSTEM

Public polls reflect the fact that overwhelming, the Canadian public feels that the family court system is biased against fathers and that fathers are getting the raw end of the deal. It’s clear that Canada’s family court system is utterly broken.

Almost always, moms get the kids and the money and dads take on the role of being nothing more than a wallet and a weekend visitor to their children. With this blatant bias in the courts, it’s no wonder that hard working citizens like Mr. Cornakovic feel that the citizens must take the law back and put it back into the hands of the citizens.

Clearly, the family courts are not working and to many, the judges have failed. Most Canadians would say that the judges have lost touch with the hearts and minds of the Canadian people.

It’s time for Parliament to do something to stop the needless destruction of so many children and their families by our incompetent family courts
