In the landmark case, believed to be the first in Australia, the man is seeking $400,000 for the mental anguish he suffered believing the 10-year-old boy and nine-year-old girl were his children. The case comes as the The Advertiser can reveal up to 30 per cent of men seeking paternity tests are proven to be not the biological fathers of children they are supporting. Liam, who had been paying child support since about 1992, is suing his former wife Meredith for fraud. To protect the children, The Advertiser is not revealing their surnames. The law suit is outlining loss of earnings, loss of use of the money spent, anxiety and depression. In a separate claim for "disregard to the plaintiff's rights" Liam also seeks exemplary damages. "At all material times, the defendant (mother) was aware, and the fact was that the plaintiff (father) was not the father," says a writ lodged at the Melbourne County Court. The writ claims Liam believed he was the father of the two children since their conception and has suffered "severe anxiety and depression" since discovering he was not their father. It claims Meredith told him he was the children's father when she became pregnant in 1990 and 1991.
